Intellectual property has increasingly assumed a vital role with the rapid pace of

technological, scientific and medical innovation that we are witnessing today. Laws

related to intellectual property, Technology and competition have co-existed for over a

century. The first two provide exclusive rights and licensing authority to the owners, while

the last, competition law, is aimed to mitigate the negative impacts of exclusivity granted

under the first two. On the other hand, as IP is considered significant source for economic

progress, any enforcement under competition law should be carefully structured to

prevent stifling technological advancements, which frequently manifest themselves in

the form of IP. In addition, IP and competition rules are increasingly significant in terms of

joint ventures, mergers and acquisitions, cross licencing, patent pooling, and licencing in

general in today's digitalization era. TRIPS also includes a provision on anti-competitive

conduct in IPR licencing, which is reflected in a number of countries laws dealing with

IPR and competition. Recent enforcement of competition law in the area of IPR, including

standard essential patent in advanced nations has achieved substantial impact on the

legal landscape for IPR owners. Licensing is a useful way to generate more profit, hence

right holders should be encouraged to licence IP as openly as feasible. Both, at the end,

are meant to promote competition, innovation, and economic prosperity. In addition,

policymakers and enforcement agencies must be aware of the nexus between

competition and IP law, particularly in light of emerging technical advancements like as

machine learning, the IoT (Internet of Things), network technologies such as 4G and 5G,

genetic engineering, and so on. On the basis of above background, this conference

would cover the national and international issues and challenges by revisiting the

synergies, tenets and practices followed under IPR, Technology and competition law.
